Rayrise Design Lab Private Limited, a private company incorporated under the laws of India, along with its affiliates (collectively referred to as "Rise", "we", "us", or "our"), specializes in designing and manufacturing standardized and customized products for individuals with physical disabilities with a mission to empower these individuals, promote independence, and enhance their quality of life (collectively, our "Services").
We operate the website https://risebionics.com, its domain name, and associated pages, features, content, mobile applications, and other services (collectively, the "Platform").
This Privacy Policy outlines how we collect, store, use, and transmit your Personal Information and forms the basis of understanding between Rise and users of its Services and/or Platform (“you”, “your”, or "User”)

1 INFORMATION COLLECTED BY RISE BIONICS

(ii) Aadhar card (for India)
(iii) Unique Disability ID (UDID)
(iv) Below Poverty Line (BPL) card (in case of minor, BPL of parents)
(v) Digital Health Card (and information made available thereunder)

1.1.3 Financial Information:
(i) Income certificates (as required)
(ii) Other financial information and documentation that will help us assess your applicability for programs for the less fortunate (as required)

1.1.4 Medical Information:
(i) Photographs of limbs or any other disability
(ii) Film or video that helps further illustrate and explain your body and/or disability
(iii) Medical scans and reports relating to body and/or disability
(iv) Hospital reports and medical records
(v) Doctor's prognosis
(vi) X-rays
(vii) Digital scans of patient's body
(viii) Other health data relevant to the particular case

1.1.5 Technical Information:
(i) Internet Protocol (IP) address
(ii) Information about your device, including manufacturer details, and browser information

1.1.6 Demographic Information
(i) Resident city, state and country

1.2 Please note that the above list is not an exhaustive list and is without prejudice to our right to obtain and process further Personal Information in compliance with the applicable law. For instance, subject to the law applicable to you, Personal Information that is published by you online on a publicly accessible platform, may not be considered Personal Information under the Applicable law nor per this Privacy Policy.

1.3 If you do not wish to provide the Personal or sensitive information requested or provide consent for use of your Personal or sensitive information, where required, or withdraw your consent for use of the Personal or sensitive information collected, Rise reserves the right not to provide services or to withdraw the services for which the information was sought/collected from you.

1.4 You must ensure that all information that you provide to us while availing any Service is true and correct. If you are aware of any errors in the information, you must request a correction of such error in accordance with Clause 9.1.2 of this Privacy Policy. We will not be responsible for the accuracy or filtration of any information provided to us, directly or indirectly, by or for any User.

2 HOW INFORMATION IS COLLECTED

2.1 We collect personal information through various means to ensure a comprehensive understanding of our users and to enhance the services we provide. The methods of information collection include, but are not limited to, the following:

2.1.1 Registration/ Information Disclosure Forms: At the time of registration and from time to time during the provision of our Service, we collect essential information through registration/ information disclosure forms provided to you, your parent or your representative. This process may involve obtaining photocopies of relevant documents to verify your identity and ensure compliance with applicable regulations. The information collected is used solely for the purposes outlined in this Privacy Policy and is safeguarded with care.

2.1.2 Third-Parties: In addition to direct collection methods, we may also receive information from third-party sources. This includes data shared by our associates, including our NGO and/or CSR associates, through post, email or other secure channels such as encrypted messaging services. We ensure that any information received from third parties adheres to privacy standards and is utilized in accordance with our commitment to protecting your personal data.

2.1.3 Information Databases & Other Third Party Sources: We may use information data basis, subject to applicable law and/or your consent, like the Health Facility Registry.

3 USE OF INFORMATION

3.1 Rise Bionics will use your Information for the following purposes:

3.1.1 Creation of your profile and an associated ID for collation of your information

3.1.2 Communication with you

3.1.3 Smooth facilitation of Services or your engagement with the Platform

3.1.4 Refinement of any of the products provided to you by Rise under the Service

3.1.5 Automated processing to provide the Services

3.1.6 Enhancing and optimizing our Services and improving the Users experience

3.1.7 Handling of complaints, questions, disputes, and participation in social media

3.1.8 Meeting obligations to our CSR and NGO associate organizations

3.1.9 Analyzing market trends and conducting research, including using such related materials for promotional and educational purposes to enhance public knowledge and awareness in the medical field

3.1.10 Communicating marketing or promotional information about our products and Services

3.1.11 Preventing, detecting, investigating, and taking action against crimes, illegal activities, suspected fraud, or violations of Terms

3.1.12 Establishing, exercising, or defending legal rights in connection with legal proceedings

3.1.13 Complying with any applicable law, regulation, legal process, or enforceable governmental request

3.1.14 Assistance in treatment and/or evaluation process in any manner relevant to your assistance and rehabilitation program

3.1.15 Any other purpose that is permitted or required, under the applicable law

3.2 Please note, if you are receiving our Services through a the program(s) of our CSR and/or NGO partners, you may be required to sign additional documentation for publishing of photographs, videos and certain medical scans and reports to promote knowledge and research, and or our business. Such documentation and consents shall be deemed to supplement the terms of this Privacy Policy in relation to your specific instance.

4 BASIS FOR PROCESSING YOUR PERSONAL INFORMATION

4.1 Our processing of personal data is conducted in accordance with established legal grounds, ensuring compliance with applicable data protection regulations. The lawful bases for processing personal data include, but are not limited to, the following:

4.1.1 Consent: We process personal data based on the clear and informed consent obtained from individuals for specific purposes. This consent is sought prior to the collection of data and can be withdrawn at any time, allowing individuals to maintain control over their personal information.

4.1.2 Legitimate interests: The processing is necessary for us to conduct our business, but not where our interests are overridden by your interests or rights. This may include:
(i) Contractual Necessity: Processing of personal data is also carried out when it is necessary to fulfill a contract with the individual. This includes any activities required to provide services or benefits as agreed upon in the contractual arrangement, ensuring that we meet our obligations effectively.
(ii) Legal Obligation: In certain circumstances, we process personal data to comply with applicable laws and regulations. This legal obligation ensures that we adhere to statutory requirements and maintain our commitment to ethical practices in all aspects of our operations.

5 SHARING OF INFORMATION WITH THIRD PARTIES

5.1 Rise Bionics will not use your financial information for any purpose other than to complete a transaction with you. We do not rent, sell, or share your Personal Information and will not disclose any of your personally identifiable information to third parties, save for and except in furtherance to provision of Services.

5.2 However, we may reasonably share your information with:

5.2.1 Service providers (such as our NGO partners or our technology service providers) assisting in our operations

5.2.2 Digital and technology service providers that we may use in connection with the provision of Services, including without limitation, cloud service providers, SaaS based technology providers, etc.

5.2.3 Business partners (with your consent)

5.2.4 Our CSR and NGO partners to provide evidence of usage of CSR and other funds allocated

5.2.5 Creation of impact reports that will be shared with NGO and CSR partners

5.2.6 Legal authorities as and when required by law

6 RETENTION OF PERSONAL INFORMATION

6.1 Subject to applicable law, Rise Bionics will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy or to comply with our legal obligations, which may include contractual obligations to our associated NGOs and CSR providers if you procured Services of Rise through a program that is made possible by any such NGO/ CSR Partner.

6.2 We may also retain your information to facilitate smooth Services that you may later require, such as for replacements or repair of any products that you may procure from Rise.

If you would like us to delete any information that you provide to us, you may request erasure under Clause 9.1.4 of this Privacy Policy.

7 TRANSFER OF PERSONAL INFORMATION

7.1 If you are an Indian resident, we endeavor to maintain all data within servers located within the territory and jurisdiction of India. However, we do work with service providers with servers and systems based abroad and your data may be transferred to such service provider to effectively provide the Service to you.

7.2 If you are a resident of a foreign country, your data may be transferred outside the jurisdiction of your residence. We endeavor to ensure that all transfers are made in accordance with the applicable law.

However, you understand that your information may be transferred to and maintained on computers located outside your governmental jurisdiction. Your consent to this Privacy Policy represents your agreement to such transfers.

8 PERSONAL INFORMATION OF CHILDREN

8.1 We may, to conduct our Services for the benefit of minors, collect and process Personal Information of such minor.

All Personal Information we collect or process about any minor is collected and processed after procuring written consent of the minors parent and/or guardian.

If you believe that any minor’s Personal Information is being collected or used by us without the permission of such minor’s parent and/or guardian, please reach out to us in accordance with Clause 14 of this Privacy Policy.

9 RIGHTS AVAILABLE TO USERS

14.3
If you believe that your privacy rights have been violated, you should call the matter to our attention by sending a letter describing the cause of your concern to the same address. You will not be penalized or otherwise retaliated against for filing a complaint.

In accordance with the applicable law, you may report privacy volitions in accordance with the law applicable to you. For instance, once notified and brought into effect, if you are a resident of India, you may raise a complaint with the Data Protection Board of India under the Digital Personal Data Protection Act, 2023.

Subject to applicable law, this Privacy Policy shall be governed by the laws of India and any and all disputes arising under or in relation to this Privacy Policy shall be subject to the exclusive jurisdiction of courts in Bengaluru.
